Terms and Conditions (and Official Rules)

Please read these Terms and Conditions before entering the Sunshot Book Awards Competition, ("Competition") by New Millennium Writings ("NMW/Sunshots" or “we”). By submitting an entry, you (“You” or “Your”) acknowledge that you are eligible to enter the Competition and have read and agree to be bound by these Terms and Conditions and any decisions related to the Competition that are made by NMW/Sunshots or any of the judges. The "Sponsor" of the Competition is New Millennium Writings ("NMW"); mailing address NMW/Sunshots, 4021 Garden Drive, Knoxville, TN 37918.
The Competition is open to all new, aspiring, and established writers, regardless of experience, who are 18 years old or older at time of entry, from anywhere in the world where the Competition is not prohibited or restricted by law. You are not eligible to enter the Competition if you are (a) a NMW/Sunshots employee or independent contractor; (b) a family member (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren), friend, teacher, or student of any of our employees, independent contractors, reviewers, or judges; (c) a judge involved in the Competition, including any reviewer who participates in selecting the Nominees and finalists.
GRANT OF RIGHTS
Entrant will retain copyright ownership of their submitted manuscript (“Entry” or “Entries”). It is not necessary to put a copyright notice on your manuscript. Under U.S. copyright law, the writer holds all legal rights to anything he/she produces unless signed away to another party. Upon selection, the First Place "Sunshot Book Award" winner (“Award Winner”) and any finalist manuscripts that are winners of the “Sunshot Book Prize” (“Prize Winner”), (collectively referred to as “Winners”), will be contacted, confirmed, and then mailed our standard book contract for Award Winners or our standard book contract for Prize Winners. Once NMW/Sunshots receives a completed and signed contract, design and production of the manuscript will begin, and will take approximately three-four months.
AGREEMENT TO TERMS AND CONDITIONS
Participation in the Competition constitutes your full and unconditional agreement to, and acceptance of, these Terms and Conditions and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Terms and Conditions and fulfilling all other requirements set forth herein.
HOW TO ENTER AND PRICING POLICY
Submissions are allowed through our online submission form (“Submission Form”) or though the mail/post office, and all entries must adhere to the respective method’s submission instructions and rules below.
ONLINE: You must submit through the appropriate Sunshot Submission Form to enter the Competition, which can be directly accessed online at https://newmillenniumwritings.submittable.com/submit, links to this form can also be found online at both sunshots.org and newmillenniumwritings.org. Follow the submission instructions and: (1) upload the complete version of your Entry manuscript; (2) follow the payment instructions and complete payment of $35 entry fee; (3) provide all requested information.

There is no restriction to style, form, topic, or content: virtually any tone, format, and/or subject matter is acceptable. You must be the only author of your Entry and own the copyright. International submissions will be accepted. All manuscripts must be in English. Works of translation are not currently allowed. Simultaneous submissions are allowed, provided we are notified immediately of acceptance elsewhere. Entries must not contain any images.
Individual poems, stories, or essays may have been published in chapbooks, journals, magazines, anthologies, and/or online. No more than twenty pages or twenty percent, whichever is higher, of the manuscript itself may have been published as a book-length work.
Your Entry must:
(1) follow all submission and entry guidelines;
(2) satisfy respective collection length requirements:
-(2a) POETRY: Collections of poetry must be between fifty (50) and eighty (80) pages in length (not including front matter, TOC, etc.)
-(2b) FICTION: Collections of fiction must be between 12,500 and 55,000 words in length (not including front matter, TOC, etc.) and may include all of, or any combination of, micro, flash, short story, long story, novelette/novella.
-(2c) NONFICTION: Collections of nonfiction must be between 12,500 and 55,000 words in length (not including front matter, TOC, etc.) and may include all of, or any combination of, micro, flash, short essay, long essay, novelette/novella.
(3) not include any identifying information anywhere in the manuscript file. Mailed manuscripts, excepting the required cover page, must not include any identifying information anywhere else.
(4) be submitted:
(4a) Online: by uploading your Entry file in the Submission Form. We prefer and highly recommend using the file format of PDF (.pdf), however the following file formats will all be accepted: Word (.docx) or (.doc), Adobe (.pdf), or Rich Text (.rtf).
(4b) File name of your manuscript should not include the author’s first or last name. It is recommended that file names do not include any blank spaces, punctuation, or symbols, other than the hyphen (-) and/or the underscore (_). See examples below.

CONDITIONS OF ENTRY
By submitting an Entry, you represent and warrant that your Entry: (a) is your original creation; (b) has not been copied in whole or in part from any other work; (c) has not previously been published as described above; (d) does not violate or infringe any copyright, trademark, privacy or publicity right, or other proprietary or intellectual property right of any person or entity; (e) is not defamatory, libelous, offensive, obscene, or otherwise illegal; and (f) is your sole and exclusive property. You further represent and warrant that you have complete rights to your Entry.
If there is a dispute as to the identity of an online entrant, the Sponsor shall retain full decision making authority over awards and prizes, furthermore, disputed identities will be determined in by methods which may include an email addresses authorized account holder. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. It is recommended that you submit under your primary email address.
By submitting an Entry online, you are given the choice to opt-in or opt-out of Sunshot Book Award’s email list and the New Millennium Writings’ email list. If you opt-in and then wish to stop receiving any emails, simply click "Unsubscribe" at the bottom of the email received, or email us a removal request at hello (at) newmillenniumwritings (dot) org.
RESULTS AND WINNING THE COMPETITION
The finalists and Winners will be announced less than 120 days following the deadline and official closing of the Competition. Winner and finalist announcements will be posted at www.sunshots.org, emailed to Sunshot and/or New Millennium Writings email subscribers, shared on social media, distributed by press release, and may be included in additional print and/or digital display advertising.
Upon selection, the Award Winner will be contacted, confirmed, and then mailed our standard Award book contract. Once NMW/Sunshots receives the completed and signed contract, the announcement will be scheduled; a check for the full cash prize will be mailed to Award Winner; design and production of the Award Winner’s manuscript will begin, which usually takes about three-four months.
The Sponsor will attempt to notify the potential Award Winner via telephone and/or email provided through the Submission Form. If the potential Award Winner fails to respond within seven (7) days after the first attempt to contact him/her, declines the award, or fails to provide any signed contract, release, or affidavit required, such winner may be deemed to forfeit the prize and publication and the Sponsor has the right to select an alternate winner in his/her place.
The selection process will consist of ten to twenty manuscripts chosen as finalists.
The First Place Sunshot Book Award will consist of an amount of $1,500 USD; print publication of Award Winner’s Entry manuscript (the “Book”) in softcover and any other format decided upon by the Sponsor (hardback, e-book, audio, etc.), and selections of the work may also be published online. The Award Winner will receive one hundred (100) softcover copies. All publishing, designing, and formatting decisions are reserved for NMW/Sunshots, however directional design input from authors will always be encouraged, considered, and appreciated.
The Award Winner will also receive the Sunshot rePRIZE, which is described in detail in the next section.
Royalties will be included in the standard publishing agreement. As detailed in the contract, the prize values of the Sunshot Book Award or Sunshot Book Prize will cover the royalties on the first five-hundred (500) copies. Royalties of thirty percent (30%) of NMW/Sunshots's net receipts for book sales will begin thereafter, excepting for prize copies, reviewer copies, copies used for rePRIZE award nominations, discounted pre-orders and/or subscriber copies, and/or copies used for any other promotional purpose, including discounted copies which may be required in the event of a winning book award nomination. If NMW/Sunshots lets the book go out of print in softcover format (or, if hardcover has been made available, both softcover and hardcover formats) all rights revert to the author.
Sunshot Book Prize
All finalist manuscripts will be considered for a Sunshot Book Prize; multiple Sunshot Book Prize can be awarded.
Sunshot Book Prize(s)
The Sunshot Book Prize will consist of print publication (copy-editing, layout design, cover design) of Prize Winner’s Entry (the “Book”) in softcover and any other format decided upon by the Sponsor (hardback, e-book, audio, etc.), and selections of the work will be published online. Sunshot Book Prize winners will receive fifteen (15) softcover copies. All publishing and design decisions are reserved for NMW/Sunshots, however directional input from authors will always be encouraged, considered, and appreciated.
All Prize Winners will also receive the Sunshot rePRIZE, which is described in detail in the next section.
Royalties will be included in the standard publishing agreement. As detailed in the contract, the prize values of the Sunshot Book Award and the Sunshot Book Prize will cover the royalties on the first five-hundred (500) copies. The Sunshot rePRIZE
The mission of the Sunshot Prize Series is to ensure that each published work, of Award Winner and Prize Winner(s), are set on a bold trajectory. Nominations for each work will be dependent on eligibility requirements met by each Book and author, eligibility requirements met by NMW/Sunshots, and availability.
The current list of available nominations for the Books of this Competition may include the National Book Awards, the Pulitzer Prize, the Lenore Marshall Poetry Prize, the Griffin Poetry Prize. the PEN/Hemingway Award for Debut Fiction, the Scotiabank Giller Prize, the Warwick Prize for Writing, the International Rubery Book Award, and any others that may be added.
All book award organizations available for nomination are independent of the Sponsor, Sunshots Book Awards, the Sunshot Prize Series, and NMW/Sunshots, and share no association. Therefore, NMW/Sunshots will not be held liable for any changes that may affect availability, eligibility, prizes, or any other aspect regarding nominations and/or the Sunshot rePRIZE. Each award has their own unique guidelines, eligibility requirements, publisher limits, and award schedules. This prevents us from guaranteeing nomination to any specific organization or award, or any quantity of nominations. However, following our core mission, each Book’s Sunshot rePRIZE will receive special attention and nomination consideration to ensure the highest potential, as determined by NMW/Sunshots.
Furthermore, because nomination opportunities may come and go, each have unique eligibility requirements that may also change without notice, NMW/Sunshots has full discretion, and retains the right, to add and/or remove nomination options, at any time, with or without notice.
NMW/Sunshots agrees to pay additional publisher contributions as may be required by nomination rules and/or guidelines (i.e. travel and accommodations of winner, award ceremony tickets, additional promotion, etc.).The costs associated with Nominations (fees, applications, copies for submission, and postage) are variable and may reach up to a maximum of $500.
The last section (back matter) of books we publish may include a "Special Acknowledgements" page listing the names of the poets and writers (i.e. those who submitted an Entry into the Competition) who helped make that book possible.
Two decades of hosting literary awards have made it clear to us that there is an under-recognized demographic, fundamental to literature's evolution: those who possess the boldness and tenacity to enter their work for consideration.
If the winner of our award goes on to win the Pulitzer, there are writers and/or poets who helped make that success possible. Their names deserve acknowledgment.

The Sponsor retains the right and full discretion to shorten, extend, and/or whether to allow a submission grace period. Any changes will be reflected here and updated on the Submission Form and/or on sunshots.org.
REVISIONS AND FINAL EDITS
Minor typos and/or grammatical errors will not negatively impact the judging of your submission. If we find any substantial issues with your manuscript file, we will contact you for resolution.
Before a manuscript goes to publication, we are happy to consider and, if possible, accommodate an author's request for minor revisions.
NMW/Sunshots reserves the right to final edits, which may include small grammar and/or style edits to the content of an a poem, story, or essay and/or omission of one or more complete poems, stories, or essays, if the edits and/or omissions are deemed by NMW/Sunshots to strengthen the overall impact, power, and influence of the collection.
We ship any physical products within 7 business days after the order is placed, with the exception of any presale/preorder products which have estimate shipping schedules on the individual product pages. If two or more unique presale/preorder products are ordered together, they will generally be shipped together based on the estimated shipping date most in the future.
Submission Refund Policy
Due to the nature of this competition we are unable to provide any refunds, credits, or exchanges for any submission fee or fees, including any presales or preorders of "Commitment" submissions.
Book, Merchandise, or Physical Product Refund
If you are unhappy with any purchase of a physical good, you may return the product by mail, in like-new condition, for a full refund within 30 days of purchase. Shipping costs may not be refunded by the seller, nor may return shipping costs be reimbursed to the buyer.
Presale/Preorder of Physical Product Refund
If you are unhappy with your decision to purchase any presale or preorder physical good, you may request a full refund within 30 days of your purchase as long as the follow two criteria are satisfied: (1) your order has not already been shipped to you and (2) the product(s) has an estimated shipping schedule begins 30 days or more in the future.
Expenses not specifically included in prize description and all taxes are the sole responsibility of the Winners. The Winners are required to comply with all applicable federal, state, provincial, if Canadians are eligible to enter, and local laws, rules and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Terms and Conditions are solely the each Winner's responsibility. Winners must complete a W9 form and supply Sponsor with his/her social security number for tax purposes. An IRS Form 1099 will be issued in the name of the Winner for the actual value of the prize received. Sponsor shall have no responsibility or obligation to the Winners or potential Winners who is unable or unavailable to accept or utilize prize as described herein. Entrants agree to be bound by the terms of these Terms and Conditions and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Competition. Winners may be required to sign and return an Affidavit of Eligibility, a Liability Release, and where legally permissible and required a Publicity Release. We award all prizes “as is” and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.
If the potential winner is at least 13 years old and considered a minor in his/her
jurisdiction of residence, Sponsor reserves the right to award the award or prize in the name of his/her parent or legal guardian, who will be required to sign the Affidavit of Eligibility, a Liability Release and where legally permissible a Publicity Release on the potential Winner’s behalf and fulfill any other requirements imposed on Winner set forth herein. Potential Winners must continue to comply with all terms and conditions of these Terms and Conditions, and winning is contingent upon fulfilling all requirements. In the event that a potential Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner.
To preserve the highest degree of competition quality, the NMW/Sunshots reserves the right to modify, extend, or terminate any Competition, at any time, with or without reason. All Entrants, of any cancelled or terminated Competition, would receive a full refund of their entry fee(s).
Failure by the Sponsor to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. Sponsor reserves the right to modify or supplement these Official Rules and Terms and Conditions with or without notice.
The Competition and all accompanying website and promotional materials are copyright of NMW/Sunshots. All rights reserved. The Competition is void outside the eligible entry jurisdictions and where prohibited by law. You agree that our decisions related to the Competition are final and binding in all matters. We reserve the right, to the maximum extent permitted by law, in our sole discretion, to change these rules or cancel the Competition at any time. We may also modify, terminate or suspend the Competition if any viruses, worms, bugs, unauthorized human intervention, or other causes beyond our control corrupt or impair the administration, security, or fairness of the Competition or submission of Entries. If you use the name or likeness of an individual in your Entry, you agree to be solely responsible for that use. You agree that we and our partners, along with any officers, employees and representatives of any of them (collectively, “Released Parties”), will not be responsible for any action brought by a person whose consent you did not obtain. The Released Parties are not responsible for: (a) any human or other error that may occur in the processing of the Entries; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction, or unauthorized access to or alteration of Entries; (c) or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, which may occur in connection with this Competition, including, without limitation, any errors or problems related to the administration of the Competition, the processing or judging of Entries, the announcement of the prizes, or the Competition-related materials. Released Parties are also not responsible for: (d) inaccurate transmission of, or failure to receive, any entry information on account of technical problems or traffic congestion on the Internet or at any Web site; and (e) injury or damage to you or any other computer resulting from downloading any materials in connection with the Competition.
